Effective March 1, 2024. Revised October 27, 2026
THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
My Responsibilities
I am required by law to keep your protected health information (PHI) private, give you this notice, follow the notice currently in effect, and notify you of any breach of your PHI. Where Minnesota law is more protective than federal law, I follow Minnesota law. I may change this notice; changes apply to all information I hold, and the current version is available on request, in my office, and on my website.
How I Use and Share Your Information
With your written consent:
Minnesota law requires your signed consent for most disclosures outside my practice, including to your other health care providers to coordinate care, to your health plan to obtain payment, and to family, friends, or others involved in your care. Consent is valid for one year or a shorter period you choose. You may revoke it in writing at any time, except to the extent I have already acted on it.
Without your consent:
I may use or disclose PHI without your consent only:
-
Within my practice for treatment and operations, including through business associates (such as a billing service) that are contractually required to protect it.
-
When consulting with other licensed professionals, without identifying you.
-
To report suspected maltreatment of a child or vulnerable adult, as required by law.
-
To prevent a clear and substantial risk of imminent serious harm to you or others, disclosing only to those able to prevent it.
-
In an emergency during a session, to your emergency contact on file or emergency services, limited to what is necessary. I will tell you afterward what was shared.
-
In response to a court order (a subpoena alone is generally not enough under Minnesota law), or for health oversight, including investigations by the Minnesota Board of Behavioral Health and Therapy.
-
When otherwise required by law, such as to law enforcement, coroners, specialized government functions, or workers' compensation.
-
To send appointment reminders.
Never without your authorization:
I will not use your PHI for marketing or sell it. If I keep psychotherapy notes (process notes kept separate from your record), I will not disclose them without your authorization except as federal law permits, such as when required by law or to avert a serious threat to health or safety.
Your Rights
You have the right to:
-
See and get a copy of your record (other than psychotherapy notes), electronically or on paper, within 30 days of a written request. I may charge a reasonable, cost-based fee permitted by Minnesota law.
-
Ask me to correct your record. If I decline, I will explain why in writing within 60 days.
-
Ask me to limit uses or disclosures. I will consider reasonable requests but cannot limit disclosures required by law or needed in an emergency. If you pay for a service in full out of pocket, I will not share information about it with your health plan unless required by law.
-
Choose how I contact you, such as a specific phone number or address. I will agree to reasonable requests.
-
Get a list of disclosures I have made in the past six years, other than for treatment, payment, operations, or disclosures you authorized. The first list each year is free.
-
Request a paper copy of this notice at any time.
